These documents govern your use of the EnergyIQ platform.
Please read them carefully.

Privacy Policy — Overview

EnergyIQ Enterprise ("EnergyIQ", "we", "us", or "our") is committed to protecting the privacy and confidentiality of the personal and business data entrusted to us by suppliers, distributors, station owners and other users of the platform. This Privacy Policy explains what data we collect, why we collect it, how it is used and your rights with respect to it.

By accessing or using the EnergyIQ platform, you agree to the collection and use of information as described in this Policy. This policy applies to all services operated under the energyiq.io domain and any custom branded deployments powered by EnergyIQ.

Data we collect

We collect information necessary to operate the platform and deliver value to all parties in the energy supply chain:

  • Account information: Full name, email address, phone number, role, and company details provided during registration.
  • KYC & compliance documents: Business registration certificates, tax identification numbers, regulatory licenses, and identity documents uploaded by distributors and suppliers as required by Nigerian law.
  • Transaction data: Sales records, purchase orders, payment receipts, bank transfer details, tank readings, pump meter counters, and expense records created or synced within the platform.
  • Device & usage data: IP address, browser type, operating system, pages viewed, feature interactions, and session duration — collected automatically via cookies and server logs.
  • Location data: Approximate geolocation derived from IP address, and precise GPS coordinates where users explicitly grant permission for station or delivery tracking.

How we use your data

Data collected is used solely to provide, improve, and secure the EnergyIQ platform. Specifically:

  • Authenticate users and manage account access across multi-tenancy deployments.
  • Process and reconcile financial transactions between suppliers and distributors.
  • Generate analytics, dashboards, and reports for platform users.
  • Send operational notifications — including low stock alerts, payment confirmations, and KYC expiry reminders.
  • Comply with Nigerian regulatory requirements, including NDPR, FIRS reporting obligations, and DPR licensing conditions.
  • Detect and prevent fraud, unauthorized access, and platform abuse.

We do not use your data for advertising or sell it to third-party marketing companies.

Data Sharing

EnergyIQ does not sell personal data. We share data only in the following circumstances:

  • Within your supply chain: Suppliers can see aggregated and transaction-level data for their own distributor network. Distributors see only their own records. No cross-tenant data is shared.
  • Service providers: We engage AWS (cloud infrastructure), Datadog (monitoring), and payment processors under strict data processing agreements. These partners process data only on our instructions.
  • Legal obligations: We will disclose data when required by Nigerian law, a valid court order, or a regulatory authority such as the NUPRC or CBN.
  • Business transfers: In the event of a merger or acquisition, data may be transferred to the acquiring entity, subject to the same privacy commitments in this Policy.

Data Retention

We retain your data for as long as your account remains active, plus an additional period required by law. Specifically:

  • Financial transaction records: Minimum 7 years (FIRS requirement).
  • KYC documents: Retained for the duration of the supplier-distributor relationship plus 5 years.
  • Usage logs: 90 days for security and debugging purposes.
  • Deleted accounts: data is anonymized within 30 days of account deletion, except where retention is legally required.

Your Rights

Under the Nigeria Data Protection Regulation (NDPR), you have the right to:

  • Access the personal data we hold about you.
  • Request correction of inaccurate or incomplete data.
  • Request deletion of your data where it is no longer necessary for the purpose it was collected.
  • Object to certain processing activities.
  • Lodge a complaint with the Nigeria Data Protection Commission (NDPC).

Terms of Service — Agreement

These Terms of Service ("Terms") constitute a binding legal agreement between you (the "User") and EnergyIQ Enterprise Ltd ("EnergyIQ") governing your access to and use of the EnergyIQ platform. By creating an account or using any part of the platform, you confirm that you have read, understood, and agreed to these Terms.

If you are using EnergyIQ on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

Acceptable Use

You agree to use EnergyIQ only for lawful purposes directly related to the downstream petroleum distribution business. You must not:

  • Submit false, misleading, or fraudulent transaction records, KYC documents, or identity information.
  • Attempt to access another supplier's or distributor's data without authorization.
  • Reverse engineer, decompile, or attempt to extract the source code of the platform.
  • Use automated scraping tools or bots to extract data from the platform.
  • Upload content that is defamatory, unlawful, or infringes third-party intellectual property rights.
  • Introduce malware, viruses, or any code intended to disrupt the platform or its users.

EnergyIQ reserves the right to suspend or terminate any account that violates these conditions, with or without prior notice.

Accounts & Access

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or use of your account. We reserve the right to enforce multi-factor authentication (MFA) to enhance security.

Payment terms

Subscription fees are billed monthly or annually in advance in Nigerian Naira (₦), unless otherwise agreed in a separate enterprise contract. All fees are non-refundable, except where required by law.

Failure to pay subscription fees within 15 days of the due date may result in suspension of platform access. EnergyIQ will provide at least 7 days written notice before any suspension for non-payment.

Limitation of liability

To the fullest extent permitted by Nigerian law, EnergyIQ shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the platform — including loss of revenue, loss of data, or business interruption — even if EnergyIQ has been advised of the possibility of such damages.

EnergyIQ's total aggregate liability for any claim arising under these Terms shall not exceed the total fees paid by you in the 3 months preceding the claim.

Termination

Either party may terminate a subscription by providing 30 days written notice. Upon termination, your access to the platform will cease and your data will be retained for the periods described in the Privacy Policy, then deleted or anonymized.

EnergyIQ may terminate your access immediately and without notice if you materially breach these Terms, particularly in cases of fraud, data misuse, or illegal activity.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
